Terms and Conditions for Purchase of Credits and Subscriptions

These are the terms and conditions (Terms), upon which Findmypast Limited (we) will sell you subscriptions (Subscriptions) or PayAsYouGo credits (Credits) to access our database of historical records and material ( Records) through the website www.findmypast.com (Site).

Findmypast Limited is a limited liability company registered in England and Wales (Company number 04369607) having its registered office at The Glebe, 6 Chapel Place, Rivington Street, London, EC2A 3DQ.

Separate terms of use apply to your general use of the Site. Our general website terms of use for the Site are located below.

Your purchase of any Credits and/or Subscriptions through our Site is subject to these Terms and by placing an order for any Credits and/or Subscriptions you agree to be bound by them. These Terms apply to all users of the Site who purchase Subscriptions or Credits or who sign up for a free trial except for commercial users. If you wish to make any commercial use of Credits or Subscriptions or free trial please contact us via the Contact Us link on our Site.

If you do not agree to these Terms, please do not purchase any Credits or Subscriptions.

We may change these Terms from time to time by changing them on the Site. By continuing to purchase or renew Credits or Subscriptions you accept these changes and agree to be bound by them. It is your responsibility to check the Terms each time you purchase Credits or renew a Subscription from us. These Terms were last updated in July 2016.

From time to time we may propose special offers or temporary promotions which may either be published on the Site, on other digital platforms or in other publications such as marketing emails, newspapers and magazines. These may be subject to additional terms and conditions which we will let you know about in those offers.

The advertisement of Credits and Subscriptions on the Site, on other digital platforms and/or in other publications is an invitation to treat only and any order from you constitutes an offer to us to buy such Credits and Subscriptions. All orders are subject to acceptance by us. There will be no contract between you and us unless and until we accept your order in accordance with the procedures detailed in these Terms.

Applicability of these terms and conditions

These Terms apply to the online purchase of Credits and Subscriptions from the Site and the redemption of vouchers codes purchased from us or a third party. They do not apply to the purchase of products and it is not possible to purchase products from the Site.

Obtaining access to and use of Records

You can see the different types of Records held on the Site for free however, to access and view most Records or use certain features of the Site you will need to register with the Site and purchase Credits or a Subscription, or use a voucher.

You may also take a 14 day free trial subject to the relevant provision of these Terms - see further below.

You may use Credits or a Subscription on the Site for your own personal use, for example to research your family history. You may also assist friends and family with their family history by telling people about the Records available on the Site and how and where they can be found. However, please note our terms below in relation to the use of your log in details.

If you are a self-employed professional genealogist using the Site in your professional capacity (Genealogist), you may use the Site to carry out research for others using either Credits or a Subscription in accordance with and subject to these Terms. Genealogist users shall not however be deemed a consumer under these Terms and consumer rights will not apply. Please refer to specific sections of these Terms which will clarify certain sections that will not apply to Genealogists.

If you work for an organisation or company that carries out research using our Records, or a library using community editions (Business User) please contact us to find out more about corporate access to the service using the Contact Us link on the Site. These Terms do not apply to Business Users. Separate terms and conditions apply to Business Users and these will be provided to you on purchase.

1. Free Trial

You may sign up to a free trial (Trial) which allows you to view a selection of Records for a period of up to 14 days ( Trial Period). In order to obtain a Trial, you will need to register with the Site and follow the prompts on screen to set up the Trial.

There is no obligation to purchase Credits or a Subscription following the Trial however we do require your credit or debit card details in order to grant you the Trial. Upon registration for a Trial you shall be asked to select which type of Subscription you would like to base your Trial on. Details about the types of Subscription available can be found on the Site here. If you do not cancel your Trial prior to the expiry of the Trial Period you shall automatically be charged for the Subscription selected on registration for the Trial and we will take payment accordingly. You may, at any time during the Trial Period. cancel the Trial by signing in to your account online and un-ticking the "Auto-renew my subscription" box or by emailing support@findmypast.com or call Customer Support on +44 (0) 20 3326 6300 Monday - Friday 9am - 5.30pm (GMT) to request cancellation.

If you are a consumer user and not a Genealogist, you will also have the right to cancel any Subscription entered into following the expiry of the Trial Period, in accordance with the Cancellations section below.

Trials are limited to one per household and we reserve the right to reject a request for a Trial if we have reasonable grounds to think that you have already participated in one.

2. Subscriptions

Different Subscriptions give access to different Records. Further details about the types of Subscription available can be found on the Site here. As an example, some Subscriptions only allow access to Records from Britain (Britain Subscribers) and some allow access to Records from around the world (World Subscribers) Descriptions may be abbreviated but to the best of our ability, are correct at the time of input onto the Site.

The minimum Subscription term will be described during the order process. Some promotional offers and/or some Subscriptions may have a 12 month minimum term (subject to any right to cancel you may have - see further below). Some offers may not be available to existing subscribers.

The expiry date of the Subscription you are purchasing is clearly stated before you finalise the purchase of the Subscription.

Usage limits apply to Subscriptions. Please see below for further detail.

Where possible, we add Records to your Subscription at no extra cost, however if we launch a major new collection of records, for example, we may need to make a separate charge for access to such Records. This will be made clear on the Site.

3. Credits

Credits may be used to view any Record on the Site unless they are subject to a special collection and this will be clear on the Site. Some Records cost more to view than others. Credits are used up when you view a Record on the Site. All applicable prices and detail of how many Credits a particular Record will cost are set out on the Site.

Credits are only valid for a fixed period of time and will expire if you do not use them in that time however expired Credits, up to a maximum of 300 Credits, will be re-credited to your account if you purchase more Credits within 3 months of expiry.

The length of time that Credits will remain valid shall depend on the number of Credits purchased and the validity period shall be stated at the point of sale.

We may change the number of Credits charged to view a Record from time to time and any price changes will be made clear on the Site.

4. How to purchase Credits or a Subscription from the Site

To purchase Credits or a Subscription you must first register with the Site. In registering, you will be providing certain personal information to us which shall be processed in accordance with our Privacy Policy You must keep your registration and log in details private and secure at all times and not share them with any other person. If you are aware that someone has access to your registration or log in details, please update your password in the "My Account" page of the Site as soon as possible. You must keep your personal information, including your email address, accurate and up to date.

To make a purchase of Credits or a Subscription on the Site you will need to:

  • Go to www.findmypast.com;
  • Select Sign in/ Register;
  • Complete the online registration. Once completed we will send you a confirmation email;
  • Once registered, it is also possible to sign in via Facebook but you will need a Facebook account.
  • Sign in to the Site and click "Subscribe";
  • Select which Subscription or Credits you wish to purchase. If you have a discount code or voucher code you will need to enter it on this page in order for it to be accepted. Once selected you will automatically be directed to the payment page if you are not using a voucher to obtain a Subscription or Credits;
  • Make payment for the Credits or Subscription by credit or debit card or enter your voucher code where prompted;
  • We will send you an initial acknowledgement by email once the order has been received. We will then send you a payment confirmation email once payment has been received (Confirmation Email); and
  • Once the Confirmation Email has been sent to you, you will automatically be granted access to the Records.

A contract between us begins when we send you the Confirmation Email after accepting your payment for Credits or a Subscription. After entering into the contract we will be under a legal duty to supply you with the Credits and/or Subscription that are in conformity with the contract.

5. Continuous Subscriptions

When you take out a Subscription, it is on a continuous basis, meaning that your Subscription will automatically renew, without notification, for the same subscription period as the initial subscription period. Monthly Subscriptions are renewed each calendar month and 12-month Subscriptions auto-renew after the 12 month period has expired. The debit or credit card originally used for payment, will be charged based on your chosen Subscription package, on the day the Subscription automatically renews.

You may elect not to renew a Subscription and can turn off the automatic renewal at any time (so long as this is no later than two days before the current Subscription is due to expire), through the "My Account" page on the Site and un-ticking the "Auto-renew my Subscription" box. Alternatively you can email support@findmypast.com or call Customer Support on +44 (0) 20 3326 6300 Monday to Friday 9am to 5:30pm (GMT). If you do not turn off automatic renewal or cancel your Subscription in accordance with the above, we will automatically renew your Subscription and will take payment before your current Subscription ends.

Subject to any statutory right to cancel that you may have, we cannot provide refunds for a continuous Subscription which has not been cancelled in accordance with this section.

Changing Subscription Package

You may upgrade your Subscription package at any time during the applicable Subscription period, subject to payment of any applicable additional fees. If you are eligible to upgrade your Subscription, you will see the 'Upgrade' option within 'My Account'. Alternatively you can email support@findmypast.com, or call Customer Support on +44 (0) 20 3326 6300 Monday to Friday 9am to 5:30pm (GMT).

You may not downgrade your Subscription package during the current Subscription period. If you wish to downgrade your Subscription package this must be done within 5 days of the expiry of the current Subscription period, through the "My Account" page on the Site. Alternatively you can email support@findmypast.com, or call Customer Support on +44 (0) 20 3326 6300 Monday to Friday 9am to 5:30pm (GMT).

Subscription Loyalty Discounts

If you have subscribed to one of our 12 month Subscriptions, you will be entitled to a loyalty discount of 10% off our listed Subscription price if you renew for a further 12 month Subscription (Discount). The Discount will not apply if you renew on a monthly Subscription basis. If you allow your 12 month Subscription to lapse but then renew it within 30 days of lapse, you will still receive the Discount. The Discount will be applied every time you renew one of our 12 month Subscriptions in accordance with the above.

6. Vouchers

Vouchers (Vouchers) may be purchased from one of our authorised third party stockists. A list of our current authorised stockists can be found on the Site here.. We will not accept Vouchers unless they have been purchased from an authorised stockist.

Vouchers can then be redeemed on the Site for a Subscription or Credits, so long as the value of the Voucher covers the value of the Subscription or Credits requested.

Voucher codes are unique and cannot be used more than once. Vouchers cannot be exchanged for cash, gift vouchers or any other cash alternative and we may restrict the use of Vouchers on certain products or apply minimum spend restrictions. Any restrictions will be made clear on the Site.

If you are unable to provide us with a valid Voucher code or if the Voucher code you provide has already been activated you will not be able to redeem that Voucher for a Subscription or Credits. We reserve the right to cancel Voucher codes at any time before they have been used if we believe you are using a Voucher code unlawfully and you may be committing an offence.

If you have any queries about a Voucher and it was purchased from us, please contact Customer Support at support@findmypast.com.

If you have any queries about a Voucher and it was purchased from an authorised stockiest, please contact the stockiest from whom you purchased the Voucher.

7. Discount Codes

We may offer discounts via a discount code (Discount Code) from time to time. These can be redeemed by entering the Discount Code into the box on the 'Select a Subscription' or 'PayAsYouGo Credits' page on the Site prior to purchasing a Subscription or Credits.

If you have purchased a Subscription using a Discount Code then, after the initial Subscription period, your Subscription will be automatically renewed at the standard list price on the Site unless you un-tick the 'auto-renew my Subscription' tick box in the 'My Account' section of the Site.

Some Discount Codes are restricted to one use per individual (where an individual is identified by their own individual email address and/or their own computer/device). Some Discount Codes may be multi-use. This will be made clear on the applicable Discount Code. If you are unable to provide us with a valid Discount Code, or if the Discount Code has expired, your discount will not be awarded. Discount Codes cannot be exchanged for cash, gift vouchers or any other cash alternative and if we believe you are using a Discount Code improperly we will refuse to honour it. By redeeming a Discount Code you consent to a cookie being placed on your computer/device. Please see our Cookie Policy. If you do not want this cookie to be placed on your computer/device, please do not use a Discount Code.

8. Free Weekends

We may, from time to time, offer a weekend period of free access to Records on the Site (Free Weekend). We will send you an email to let you know when a Free Weekend is about to start (Free Weekend Email).

Access over a Free Weekend lasts from 12:00pm midday (GMT) on the Friday until 11:59am (GMT) on the Monday. To access Records during a Free Weekend you will need to be registered and signed in to the Site.

The following Records (Excluded Records) are not available during a Free Weekend: the UK Electoral Registers (2002-2013) the UK Companies House Directors (2002-2013) and the 1939 Register record sets. Other Records may not be available on any given Free Weekend and we will notify you of these in the Free Weekend Email.

The Free Weekend Email will provide full detail of how your particular Subscription or Credits are affected during the Free Weekend. However, as an example:

· Britain Subscribers will be able to access all World Subscriber Records (except for Excluded Records) during the Free Weekend.

· World Subscribers will receive an additional three days added on to the end of their current Subscription period, free of charge. This is cumulative so that for every Free Weekend offered during the applicable Subscription period, three days will be added. If we offer three Free Weekends during the applicable Subscription period, nine free days will be added to the end of the Subscription period.

If you have purchased Credits to access Records, during a Free Weekend, you will not use up any Credits to access and view Records, except for Excluded Records. Excluded Records will continue to use up Credits purchased.

Usage limits apply on the number of Records you may access during a Free Weekend - please see further below.

9. Fair usage

We have a fair usage limit on the number of Records you may view. Different limits apply depending on whether you are accessing Records on a Subscription, Credit or Trial basis.

The following usage limits apply to all access to our Records, on a Subscription or Trial basis:

· If you access Records on a Subscription basis, you may access a maximum of 5,000 Records in any calendar month (Month), subject to a maximum of 500 Records in any 48 hour period (Limit). The Limit does not apply where you are accessing Records on a Credit basis as such access is 'pay as you go'.

  • During a Trial, you may access a maximum of 600 Records (Trial Limit).

The following usage limits apply to all access to our Records, on a Subscription, Credits or Trial basis:

· During a Free Weekend, you may access a maximum of 1,000 Records per 24hr period (Free Weekend Limit). The Free Weekend Limit will count towards your Limit, if applicable. For example, if you have a Subscription and you access 2,000 Records over a Free Weekend and have not accessed any other Records in that Month, you will only be able to access another 3,000 Records that Month.

If you get close to the applicable limit we will send you an email to alert you. If you are viewing Records on a Subscription basis, once the Limit has been reached, you will need to wait for the next Month to start, when the Limit is automatically reset. If you are on a Trial, you will need to buy a Subscription (or Credits) to view more Records. If you are viewing Records during a Free Weekend, you will revert to viewing Records under the Limit or you will need to start using Credits.

There is no carry over permitted of any unused Limit or Free Weekend Limit from one Month to the next Month. There is no carry over permitted of any unused Trial Limit if you subsequently go on to purchase a Subscription or Credit.

10. Your personal information

When you purchase a Subscription or Credits, you will need to provide us with certain personal information to enable us to process your order.

Our privacy policy sets out how we use any of your personal information you give us.

Any personal information which you provide to us when you register with the Site or purchase a Subscription or Credits must be true, accurate, current and complete in all respects. You agree not to impersonate any other person or entity or to use a false name or a name that you are not authorised to use when purchasing Subscriptions. You will notify us immediately of any changes to any personal information supplied to us.

11. Age of consent

Although you may be able to register as a user of our Site if you are under 18, please note that we do not sell Credits or Subscriptions to under 18s. All Credits and Subscriptions must be purchased by an adult of 18 or over using their own account details.

By submitting an order, you are confirming to us that you are 18 or over.

If we discover or are of the opinion that you are not legally entitled to order Credits or a Subscription, we shall be entitled to cancel the order immediately, without notice to you.

 12. Price and payment

All prices are inclusive of VAT where applicable at the current rates.

All prices are correct at the time they are given. Prices are liable to change at any time but changes will not affect orders for which you have already paid. If we change the Subscription price (which we may do at any time), this will not affect your current Subscriptions but the higher price will apply to Subscription renewal. We will always inform you by way of email if any Subscription charges will be increased in your next renewal period and you can always choose not to renew your Subscription (see Continuous Subscriptions above).

We may also change the number of Credits charged to view a Record from time to time.

It is always possible that some of the Credits or Subscriptions listed may be incorrectly priced. We will verify prices as part of our sale procedures so that the correct price will be stated at the point of sale. If we discover a manifest error with our prices then we may cancel your order and refund you.

When making a purchase via the Site, you can pay using a credit or debit card through our secure third party payment gateway. All credit/debit card purchases are subject to validation checks (which you consent to) and authorisation by the card issuer. If the issuer of your payment card refuses to or does not for any reason authorise payment to us for a particular purchase, we will not accept your order. Please note that it is possible that your card issuer may charge you an online handling fee or processing fee. We are not responsible for this.

If you are redeeming a Voucher to obtain Credits or a Subscription, you do not need to pay any further money on the Site. Just follow the prompts that appear on the Site to redeem the Voucher.

 13. Cancellations

This Section shall only apply to consumer users of the Site. If you are a Genealogist or other commercial user of the Site, you will not have the right to cancel a Subscription of Credit in accordance with the below.

If you change your mind or for any other reason decide you do not want a Subscription or Credit package, you may cancel your order within fourteen days after the day on which the contract is entered into (Cooling-Off Period) without giving any reason and we will give you a full refund

To cancel the purchase of a Subscription or Credits, you must inform us:

· in writing either to the address noted at the end of these Terms or by emailing us at support@findmypast.com giving us your name, address and order reference; or

· by telephone by calling us on +44(0)20 3326 6300 Monday to Friday 9am to 5:30pm (GMT), giving us your name, address and order reference.

The right to cancel will apply to a Subscription taken out after a Trial has ended and where you did not cancel your Trial prior to the expiry of the Trial.

Please note that where you have obtained a Subscription or Credits via redeeming a Voucher on the Site, these cannot be cancelled in line with the above since these rights only apply to distance sales. You may have an alternative right to cancel or exchange if this is offered by the stockist who originally sold you the Voucher. You will need to speak to the stockist who you purchased the Voucher from.

Details of the consumer rights described above, and an explanation of how to exercise them, are provided in the Confirmation Email. Nothing in this section affects your legal rights.

14. Express consent to start access to Records

This Section shall only apply to consumer users of the Site. If you are a Genealogist or other commercial user of the Site this Section does not apply.

If you wish to access Records before the expiry of the Cooling-Off Period, then you expressly request that we begin the supply of digital content (i.e. allow you to access Records) before the end of the Cooling-Off Period. You acknowledge that once we have begun the supply of the Records that you lose the right to cancel and we shall not be obligated to provide a refund.

15. Refunds

This Section shall only apply to consumer users of the Site. If you are a Genealogist or other commercial user of the Site this Section does not apply.

Subject to the following sentence, if you cancel a contract for Subscriptions or Credits within the Cooling-Off Period then we will refund all monies that you have paid to us in respect of the contract being cancelled. As stated above, if you have given your express consent to us to provide access to Records in the Cooling-Off Period and if we have begun that supply, we shall not be obligated to provide a refund.

We will aim to process any refund due to you within 3 working days and, in any case, not later than 14 days after the day on which we were informed about your decision to cancel the contract.

 16. Intellectual Property Rights in Records

The Records on the Site are provided by third party licensors (Licensors). In most instances the copyright or database rights owner is displayed as part of the Records. The Licensors shall retain all intellectual property rights in the Records. You cannot use the Records to create your own work such as databases, articles, blogs or books, or copy or reproduce the Records (either in whole or in part), or publish them, for a purpose other than personal use, without our prior written permission (and/ or that of the Licensor of the Records).

If you wish to publish or otherwise professionally use the Records please contact us.

If we reasonably suspect you are in breach of this section we may, without notice, suspend or terminate your Subscription and/or Credits and shall not be liable to you to refund any Subscription or Credit fees already paid, unless you can prove to us that you were not using the Records in contravention of these Terms.

If you believe that you own the copyright or any other intellectual property right in any of the Records on the Site and we have not recognized you as the copyright owner please contact us and we will work with you to resolve this.

17. Content created by Users

If you use the Site to publish material (including your family tree), make comments or participate in forums, you do so in accordance with our general website terms of use for the Site located below.

You are solely responsible for managing the content which you create, including managing the privacy settings which are available to you.

You shall retain the copyright in any content which you create or publish on the Site however by publishing any content you consent to us making it available to other users of the Site, and to users of other websites that are either part of our company group or with whom we have a partnership, and by internet search engines. You also consent to us using it for marketing, product improvement or any other commercial purposes. If you do not want to allow us to do this, you should not publish such content on the Site.

We will not however use any of your personal information without first obtaining your written permission.

Your registration and payment information and private conversations between members are always kept private and secure.

Subject to the liability section below, we disclaim all liability for any loss you may suffer as a result of content created by you and made available by you in accordance with this section being abused by a third person.

 18. Our right to amend Records

We reserve the right to make changes to the Records and services we offer on the Site without notice at any time. This includes the right to withdraw any Record offered on the Site. We may, for example, cease to provide Records from a particular data set at any time.

Where possible, we add Records to your Subscription at no extra cost, however if we launch a major new collection of records, for example, we may need to make a separate charge for access to such Records. This will be made clear on the Site.

We shall not be liable to anyone for withdrawing any Records from the Site or for refusing to accept an order.

19. 1939 Register death checking service.

We may from time to time provide a free death checking service in respect of Records held in the 1939 Register. This service allows you to request that certain 'closed' Records be opened, if you have evidence to show that the individual whose details are contained in the Record are no longer alive. This service shall only be available if you have a Subscription with us and not if you have only purchased Credits. Please see the FAQ s on the Site for full detail of this service and how to request it.

20. Termination of your right to a Subscription and Credits

If you are in breach of these Terms or our general website terms of use for the Site located at then we may terminate your right to access Records via a Subscription or Credit. If we cannot take payment for a renewed Subscription or if you regularly exceed the limits on use of Records set out in these Terms then we may terminate your access to Records. In such a circumstance, you will not be entitled to a refund on any amounts paid.

 21. Liability

Nothing in these Terms shall limit or exclude our liability to you for death or personal injury caused by our negligence or for fraudulent misrepresentation or any other liability that may not, under English law, be limited or excluded.

Subject to this, in no event shall we be liable to you for any business losses and any liability we do have for losses you suffer arising from any contract shall not exceed the purchase price of the relevant Subscriptions and/or Credits and is strictly limited to losses that were reasonably foreseeable. Losses are foreseeable where they could be contemplated by you and us at the time your order is accepted by us.

We shall not be obliged to perform our obligations under this agreement to the extent that we are prevented, hindered or delayed by reason of 'Force Majeure' which shall mean any cause or event beyond our reasonable control and including: war, civil war, armed conflict, terrorist attack, riot, civil commotion, malicious damage; compliance with any law or governmental order, strikes, or other industrial disputes, accidents, explosions, breakdowns of plant or machinery, failure of transport links, failure of telecoms links, unavailability of the internet or any utility, fire, flood, storm or adverse weather conditions, epidemic or pandemic, acts of God or failure to perform by our suppliers or sub-contractors.

 22. General

If any part or provision of these Terms is found to be unenforceable, this shall not affect the validity of any other part or provision.

You may not assign, sub-license or otherwise transfer any of your rights under these Terms. We may assign these Terms or any rights hereunder without your consent or notice.

These Terms supersede any previous versions.

These Terms shall be governed by English law, and you agree that any dispute between us regarding them or the Site will only be dealt with by the English courts, provided that, if you are a consumer and not a business user and live in a part of the United Kingdom other than England, the applicable law of that part of the United Kingdom will govern and any dispute will only be dealt with by the courts there. Nothing shall prevent us from bringing proceedings to protect our intellectual property rights before any competent court.
